Acceptable Use Policy

This Acceptable Use Policy (‘AUP’) sets out the categories of content and conduct that are prohibited on the Mylikeness marketplace. It applies to all Users and to all Content transmitted through the Service. It is incorporated into and forms part of our Terms of Service. Because the Service enables the licensing of a Creator's likeness (including for use in AI-generated content), we hold Users to a heightened standard of consent, verification, and truthfulness.

1. Scope

1.1. This AUP applies to every Creator, Agency, and Team Member using the Service, and to every piece of Content — including Likeness Assets, proposals, messages, Deliverables, and public listings — transmitted through the Service.
1.2. Capitalised terms used but not defined in this AUP have the meanings given to them in our Terms of Service.

2. Guiding Principles

Mylikeness is built on three commitments:

  • Consent is non-negotiable. A Creator's likeness may only be used within the scope, purpose, territory, duration, and exclusivity set out in the executed Licensing Agreement, and never for purposes the Creator has excluded.
  • Verification underpins trust. Creators receiving payouts complete identity verification via Stripe Identity. Agencies undergo counterparty checks where required. All licences are executed through signed digital agreements.
  • Honesty in publication. AI-generated Content that is likely to be mistaken for authentic footage must be clearly and truthfully labelled.

3. Prohibited Content

The following Content is prohibited and will result in immediate removal, licence revocation, and (at our discretion) suspension or termination of the offending account:

3.1 Content involving minors. Any depiction (real or synthetic) of a person who is, or appears to be, under the age of eighteen (18), including in a sexual, suggestive, exploitative, or harmful context.
3.2 Non-consensual intimate imagery. Any sexual or nude depiction of a Creator without an explicit, unambiguous, and separately-recorded consent for that specific use, or of any person other than the Creator whose likeness is licensed.
3.3 Impersonation & unauthorised likeness use. Any Content using the likeness of a real person other than the licensing Creator, including deceased persons, public figures, or third-party performers, without a valid separate licence and evidence of consent.
3.4 Political & election-integrity content. AI-generated Content that (i) portrays a real politician, candidate, or public official making statements they did not make; (ii) is intended or reasonably likely to mislead voters; or (iii) impersonates an electoral authority or process. Advocacy content that is clearly labelled as AI-generated is not automatically prohibited, but is subject to Section 3.6.
3.5 Defamation. Content that falsely portrays any person as having committed a crime, engaged in misconduct, or acted in a manner that would be defamatory under applicable law.
3.6 Hate, harassment & incitement. Content that promotes violence, terrorism, or hatred against any group or individual on the basis of race, ethnicity, national origin, religion, gender identity, sexual orientation, disability, or other protected characteristic.
3.7 Illegal goods & services. Content promoting the sale of narcotics, weapons, human trafficking, unlicensed financial products, unregistered gambling, or any activity unlawful in the applicable jurisdiction.
3.8 Fraudulent or misleading advertising. Content making unsubstantiated claims of health outcomes, financial returns, or endorsement by third parties who have not endorsed the underlying product or service.
3.9 Content in a Creator's declared ban categories. Any Deliverable that falls within a category the Creator has excluded on their profile or in the Licensing Agreement (for example: alcohol, gambling, tobacco, adult, pharmaceutical, politics, cryptocurrency, or any custom exclusion).
3.10 Malware & security abuse. Content containing viruses, malware, spyware, or that is designed to disrupt, damage, or gain unauthorised access to any system.

4. AI-Generated Content Standards

4.1 Mandatory disclosure. Every Deliverable that (a) is materially AI-generated using a Creator's Likeness Assets, and (b) is intended for public distribution, must include a clear and legible disclosure that the Content is AI-generated. Acceptable forms of disclosure include an on-screen watermark, an initial caption card of at least 2 seconds, or a written statement in the primary caption of the publication.
4.2 Watermarks & provenance. Where technically feasible, Agencies must preserve platform-issued digital watermarks and provenance metadata (including C2PA-style content credentials). Removing or falsifying watermarks or provenance metadata is prohibited.
4.3 Sensitive categories. Additional consent is required for AI-generated Content in sensitive categories, including medical, therapeutic, endorsement of specific brands beyond the Deal scope, or portrayal of the Creator in a specific religious or political context.
4.4 Training rights. Unless expressly permitted in the Licensing Agreement, Agencies must not use Likeness Assets or Deliverables to train, fine-tune, or otherwise develop generative-AI models, whether general-purpose or specific to the Creator.

5. Prohibited Conduct

Users must not:

  • solicit off-platform transactions with the intent of avoiding Platform Fees, safeguards, or Escrow;
  • misrepresent identity, affiliation, or eligibility, including by supplying false identity documents;
  • coerce, threaten, or harass another User;
  • circumvent, disable, or otherwise interfere with security, moderation, or verification systems;
  • scrape, copy, or otherwise extract data from the Service by automated means without our prior written consent;
  • abuse the dispute, refund, or chargeback process in bad faith;
  • attempt to reverse-engineer, decompile, or derive source code from any part of the Service;
  • upload content that is unlawful in the jurisdiction in which they upload it or in the jurisdiction into which they publish it.

6. Verification & Consent

6.1. Creators must complete identity verification (via Stripe Identity) prior to receiving payouts.
6.2. Each Deal must produce an executed Licensing Agreement recording the parties, scope, term, territory, exclusivity, moral-rights position, ban categories, and price.
6.3. Every Deliverable must be submitted for Creator approval before publication. Where a Creator declines approval, the Deliverable must not be published, released, or distributed by the Agency.

7. Enforcement

Mylikeness may take one or more of the following actions in response to a breach or suspected breach of this AUP:

  • issue a written warning;
  • remove Content and revoke the associated licence;
  • withhold, reverse, or return Escrow funds pending investigation;
  • suspend or terminate the offending account;
  • report the breach to law-enforcement or regulatory authorities where required or appropriate;
  • bar the offending User from re-registering.

8. Reporting Violations

8.1. To report a violation of this AUP — including impersonation, misuse of a likeness, unauthorised distribution, or content in breach of a Licensing Agreement — please submit a support ticket via the ‘Trust & Safety’ category in your dashboard, or if you do not have an account, email support@mylikeness.com.au with the subject ‘Trust & Safety report’.
8.2. Reports should include: (i) the identifier of the Content or Deal in question; (ii) the specific provision of this AUP allegedly breached; (iii) any supporting evidence; (iv) your contact details.
8.3. We treat verified reports as urgent and typically respond within one (1) business day for Sections 3.1 and 3.2, and within three (3) business days for other categories.

9. Appeals

A User whose account or Content has been actioned under this AUP may appeal by submitting a support ticket via the ‘Trust & Safety’ category in their dashboard within thirty (30) days of the action, or by emailing support@mylikeness.com.au with the subject ‘AUP appeal’. Appeals are reviewed by a Mylikeness team member not involved in the original decision. Decisions on appeal are final and binding as between the User and Mylikeness, and are without prejudice to any rights the User may have against a third party.
